Chickens are not permitted in Marbella Vineyards HOA
We continue to have members of the community inquiring about keeping chickens in their backyards based upon a new law that allows chickens in backyards under certain circumstances. The HOA Board of Directors at Marbella Vineyards has confirmed with an HOA attorney that the new law, A.R.S. § 11-820.04, does not supersede a planned community associations’ declaration of restrictions, such as the Marbella Vineyards Declaration of Covenants, Conditions and Restrictions (“Declaration”).
Section 4.4 of The Declaration prohibits fowl and poultry on Lots. There are no exceptions. Fowl and poultry include chickens. Therefore, chickens cannot be kept in the back yards of any Lots in Marbella Vineyards.Thank you.
